ONLINE BIDS (ABSENTEE BIDDING) Beginning Tuesday, May 28, 2013, place your maximum bid directly at swanball.com. An Online Bid authorizes The Swan Ball 2013 to bid for you on one or more lots up to the maximum dollar amount you specify. The Swan Ball 2013 will purchase the lot of your choice for the lowest possible bid and never more than the amount you have authorized. Online Bids are a binding agreement to purchase.

LIVE AUCTION AND BID BOARD AT THE SWAN BALL  Ten selected lots will be auctioned live immediately following entertainment in the ballroom. The remaining lots are sold on a silent bid basis on The Big Board on the loggia, excluding lots previously sold. These Big Board lots will be closed and sold approximately 30 minutes after the conclusion of the live auction.*

LIVE  AUCTION AND BIG BOARD AT THE NEW PARTY  Twelve selected lots will be auctioned live at the New Party on Tuesday, June 4, 2013, via live bidding. 30 lots are sold on a silent bid basis on The Big Board. These lots will close on Tuesday, June 4, 2013.  You will have the opportunity to bid on all lots, including those to be sold at the Swan Ball on June 8, 2013.*

SUCCESSFUL BIDS AND PAYMENTS  Auction purchases should be paid for on the evening of the Auction. Conditions of sale require that buyers pay for their purchase(s) no later than June 25, 2013. After each lot is auctioned, the high bidder will sign a binding agreement to purchase that lot. In the event of any dispute between bidders, The Swan Ball shall have sole and final discretion either to determine the successful bidder or to re-auction and resell the lot in dispute. If any dispute arises after the sale, The Swan Ball’s records shall be conclusive in all respects. All sales are final and are nontransferable for resale. Payment may be made by check, Visa®, MasterCard® or American Express®. Please make checks payable to Cheekwood, The Swan Ball 2013. Credit card sales after June 25, 2013, are subject to an additional two percent processing fee.

BUYER’S RESPONSIBILITY Trips are sold as described in the catalog. All trips are to be taken during the time specified in the trip description. Special invitations are subject to the schedules of the hosts who have extended them and may not be available if trips are changed. When private homes are included, the properties must be used only as and when specified and returned in the condition in which they were donated. Private home trips are not transferable without the prior written consent of the donor. Any extensions or date changes are subject to availability and will be made at the buyer’s expense. Date changes may result in the loss of trip components, and additional fees may be incurred by the buyer. Swan Ball trips cannot be exchanged for other destinations. There is no residual cash value of any component of any trip or item. If ticketed events are canceled, tickets are non-refundable or transferable. The Swan Ball reserves the right to make substitutions of equal value if circumstances pertaining to any portion of any component of the trip change due to events beyond the control of The Swan Ball. Taxes, ground transportation (including rental cars), international fees, internal air, gratuities and amenities are not included unless indicated. The buyer is responsible for clarifying questions about any component of the trip prior to departure. Some international trips may require a visa. Please determine this well in advance of your departure to allow time for processing. Trip Coordinators will be listed in the buyer’s packet. Please book your trip as early as possible to avoid disappointment regarding availability.

TRIP INSURANCE AND CANCELLATIONS Trip insurance is the responsibility of the buyer. The Swan Ball agrees to make its best effort to deliver a trip as sold. In the case that a trip must be canceled or changed for reasons beyond the control of The Swan Ball, the buyer agrees to select a comparably-priced trip or a refund of the purchase price minus any expenses by The Swan Ball. Cancellations due to a decision of the buyer are not the responsibility of The Swan Ball and no refund will be made to the buyer. Cancellation policies of each donor are binding.

ACCOMMODATIONS AND AIR TRAVEL All accommodations are subject to availability and based on double occupancy. Airfare, including international and domestic flights, and ground transportation are the buyer’s responsibility and not included unless specified. Airline tickets are coach class unless otherwise specified. Air travel is based strictly upon availability of promotional seating, which may affect the buyer’s preferred schedule. No miles can be earned from promotional tickets or donated miles, and no stopovers are allowed unless otherwise specified on your airline voucher. You may not use your own miles to upgrade donated tickets. The Swan Ball is not responsible for any expenses incurred or inconvenience experienced due to the late arrival of a regularly scheduled flight that causes a missed connection. Availability will be very limited on peak reservation demand days. Peak reservation demand days for international travel are Fridays, Saturdays and Sundays between the months of April and November each year. Private air is subject to availability as determined by the donor, and restrictions will apply in all cases. Due to weight and space restrictions, all oversized luggage, including golf clubs, skis and large suitcases, may incur excess baggage fees or may have to be shipped separately at the expense of the buyer. Values are based on regular retail rates. Values by donor are exclusive of any promotions, discounts or specials.

 ALL LOTS ARE NON-TRANSFERABLE, NON-REFUNDABLE, AND CANNOT BE EXCHANGED OR REDEEMED FOR CASH.
